1. Introduction.

1.0; (1.0.0) The purpose of this document is to outline Zyrv's Terms of Service, to be hereby referred to as "the ToS". With that in mind, for the purposes of this document — (1.0.1) Terms such as "include", "includes", "including", "IE", "such as" and "etcetera", within the context of the ToS, are deemed to include the terms "without limitation" and/or "but not limited to" immediately thereafter. (1.0.2) All terms as defined by the ToS, within the context of the ToS, are deemed applicable to similar, related, and/or interchangable terms. (1.0.3) "Zyrv" refers to this website (Zyrv.com) and everything attached to it, including its software, database and all material and content (hard-coded, soft-coded and submittions alike), but excluding that which is beyond its legal scope, that which its operators are not legally authorised to append to it and excluding that which otherwise contravenes one or more components of the ToS; In the context of legal rights and permissions, "Zyrv" refers to the creator/owner of this website (Zyrv.com), Caleb Mazalevskis; (1.0.4) "CMS" is an abbreviation for "Content Management System", which within the context of Zyrv, refers to Zyrv's software; (1.0.5) A "user" refers to any person and/or entity that accesses or uses any part or component of Zyrv in any way whatsoever, whilst a "member" refers to any user that holds an account with Zyrv; (1.0.6) The terms "account" and "membership" are wholely interchangable; (1.0.7) "Staff" refers collectively to those members of Zyrv within the "Administrator" and "Global Moderator" permissions groups; (1.0.8) "Submittion" refers to the parts and components of Zyrv that source from user interaction with the CMS, including library contributions, forum threads, forum posts and RPs, but excluding that which is inaccessible by non-staff users and that which is generated automatically by the CMS (such as, for example, Sessions); (1.0.9) "Community" refers collectively to all members of Zyrv.
1.1; (1.1.0) First and foremost, the ToS applies to the entirity of Zyrv, and by way of either being a user of Zyrv and/or accessing any materials, content, intellectual propriety, provisions subsequent of Zyrv and/or provisions further subsequent of, you are acknowledging that the said accessed is entirely subject to the ToS, and therefore, are agreeing that all your actions and usage in regard to aforementioned said accessed, have been and will continue to be, in full compliance with the ToS. This agreement of compliance will be hereby referred to as the "ToS agreement". (1.1.1) The ToS applies solely to the aforementioned, therefore excluding that which is beyond the legal scope of Zyrv. (1.1.2) A ToS agreement is a binding legal agreement, and therefore, if you are unable to form a binding legal agreement, for any reason whatsoever, you are hereby deemed to be ineligible to form a ToS agreement until such is no longer the case. (1.1.3) If you are 13 years of age or younger, you are hereby deemed to be ineligible to form a ToS agreement until you are no longer 13 years of age or younger, unless an entity (such as a parent or legal guardian) capable of forming a binding legal agreement on your behalf, expresses to Zyrv, specifically, their consent to your forming a ToS agreement and your active participation with Zyrv. (1.1.4) Zyrv reserves the right to reject third party consent to forming ToS agreements, regardless of reason. (1.1.5) Individuals or entities previously stripped of their ToS agreement and/or banned from accessing Zyrv are ineligible to form a ToS agreement. (1.1.6) If there exists any part or component of the ToS that you have not fully read and/or do not fully understand, you are hereby deemed to be ineligible to form a ToS agreement until such is no longer the case. (1.1.7) If, for legal reasons or otherwise, you are ineligible to form a ToS agreement, you must take immediate action to rectify that which signifies your ToS agreement as to ensure that the ToS agreement is no longer signified, and thus, nullified. (1.1.8) Failure to comply with a ToS agreement may result in termination of your account (if you own an account), and potential legal action (where permitted by law, and depending on the nature and context of the failure).
1.2; (1.2.0) Staff reserves the right to make changes and/or modifications to the ToS as it sees fit at any time without prior consultation to any person(/s) or entities. (1.2.1) In such an event, upon implementation of said changes and/or modifications, all previous versions and/or states of the ToS will be rendered null and void, and the updated version or state of the ToS will be (subject to 1.2.2 and 1.2.3) immediately applicable to all ToS agreements. (1.2.2) In such an event, membership will be notified by email of the changes and/or modifications, and implementation is regarded as such at the time the updated ToS becomes available and membership has been notified. (1.2.3) In such an event, should you be unable to agree to changes and/or modifications to the ToS, a grace period of no less than seven (7) days will apply to your ToS agreement, whereby the previous ToS will apply rather than the updated ToS, as to allow you to continue accessing and using Zyrv for the length of the grace period without renewal of your ToS agreement, after which it will be expected that you either nullify or update your ToS agreement. (1.2.4) The date of the most recent revision of the ToS is included at the end of this document.
1.3; (1.3.0) Zyrv is neither owned, administrated nor operated by any government, corporation, business, company, faculty or institution, nor does it engage in shares or exist as any of said entities — Zyrv, as of current, exists as a privately owned and operated, non-profit internet community. (1.3.1) Zyrv may change this state of existence (such as, to become a business) at some stage in the future and reserves the right to do so; however, such a change is unlikely to occur in the immediate future, and should such a change occur, the ToS will be modified accordingly (the purpose of this document, a business is defined as a entity which is capable of providing a taxable profit for its owners, operators and/or shareholders).


2. Service.

2.0; (2.0.0) Zyrv is an on-going dynamic creation which does not regard itself in terms of version, revision or edition — it will change on an as per relevant and/or as per necessary basis, and aside from as per stated in the ToS, is neither required to document nor clearly advise upon such changes, nor is it required consult any person(/s) or entities regarding such changes and such changes may occur at any time for any reason whatsoever. (2.0.1) As such, Zyrv, though endeavouring to be the best that it can be and provide the absolute best service possible within its capacity, makes absolutely no guarantee of availability and absolutely no guarantee to be uninterrupted, timely or error-free. (2.0.2) The entirity of Zyrv, including any services offered or provided, is provided on an "as is" and "as available" basis and is provided with absolutely no warranty of any kind, nor any guarantee that any parts and/or components of Zyrv will meet your expectations, required criteria or requirements as a member and/or user. (2.0.3) Zyrv, as an on-going dynamic creation, is also an incomplete creation — many of its parts and/or components may not necessarily work as per intended, as is the nature of unfinished creations — Zyrv makes no claim to the contrary.
2.1; (2.1.0) Zyrv will neither harbour nor tolerate the usage of any of its services, or any part or component of its entirity, in ways deemed to be non-compliant with the ToS in any way whatsoever. (2.1.1) You will not engage Zyrv or any of its services in any intentionally abusive or detrimental manner (such as through utilising exploits or weaknesses in the CMS as a means to obtain results regarded as undesirable by Zyrv). (2.1.2) Zyrv will neither harbour nor tolerate the usage of any of its services, or any part or component of its entirity, in ways that contravene the constitution or laws of the Commonwealth of Australia, or in ways that contravene the laws of your country of residence, in any way whatsoever. (2.1.3) You will not engage Zyrv or any of its services in any intentionally illegal manner. (2.1.4) You agree that the entirity of your conduct regarding Zyrv will be in full compliance with the laws of your country of residence. (2.1.5) You are strictly forbidden from encouraging unlawful behaviour by and/or towards other users and/or third parties. This includes the discussion of criminal activities — if you wish to discuss criminal activities, keep it to yourself or discuss it elsewhere.
2.2; (2.2.0) You are neither required nor obliged to use or continue using Zyrv for any specific period and/or length of time whatsoever — where, when and how you do so, how often, and for how long, is entirely your own decision and of your own discretion, so long as it is not in contravention of the ToS.
2.3; (2.3.0) With exception of where you maintain a separate and/or additional agreement with Zyrv that states otherwise, Zyrv is an absolutely and unconditionally free service, and thus, you will never be charged nor invoiced for your access and/or use of Zyrv.


3. Membership.

3.0; (3.0.0) You are neither required nor obliged to be a member to access Zyrv or its services. However, whilst not logged in as a member, Zyrv reserves the right to restrict your access and usage as so that parts and/or components of Zyrv intended solely for members are unavailable to you. (3.0.1) You are neither required nor obliged to maintain activity within the Community, and are you are neither required nor obliged to maintain your account for any specific period and/or length of time whatsoever — where and when you do so, how often, and for how long, is entirely your own decision and of your own discretion, so long as it is not in contravention of the ToS. However, be aware that non-validated accounts, after 7 days of inactivity, and any accounts, after 720 days of inactivity, will be purged from the database during routine maintenance.
3.1; (3.1.0) You are neither required to submit nor maintain accurate account details. However, you are required to ensure, and such is solely your own responsibility, that your account details are neither deliberately misleading nor fraudulent in any way whatsoever. (3.1.1) You are solely responsibility and solely accountable for any and all activity that occurs under your account. (3.1.2) You are strictly forbidden from sharing your account password — doing so is a compromise of the integrity of your identity, and thus, can't be allowed. In other words — the same membership can't be held by multiple users. (3.1.3) Be aware that, aside from yourself, nobody, Zyrv and its staff included, has any valid reason to know what your password is, and therefore, nobody has the right to ask you for your password and you have no valid reason to share it. Also, be aware that passwords are converted to hash keys before being stored on the database — should you forget or lose your password, though it is possible to reset and/or change your password, it is not possible to retrieve it nor will any user, staff or otherwise, know what your password is, assuming you have not disclosed it to anyone. (3.1.4) You are solely responsibility and solely accountable for the protection of your password. (3.1.5) A single user may have multiple memberships, and thus, you are allowed to own and operate multiple accounts. However, if you own or operate multiple accounts, staff reserves the right to question your intentions and reasons for doing so, and in the event that this right is activated, you are required to have a valid reason for maintaining each of your accounts. A reason that contravenes the ToS is not a valid reason.
3.2; (3.2.0) Zyrv reserves the right to delete any account from its database and/or suspend any membership at any time for any reason whatsoever. Though in most cases, it will do so, Zyrv is not required to specify or explain these reasons to you.


4. Etiquette.

4.0; (4.0.0) It is both expected and required that all users will maintain as best a standard of online etiquette ("netiquette"), common courtesy and mutual respect as possible at all times whilst accessing or using Zyrv or any of its services. (4.0.1) Exactly what comprises the required standards of online etiquette, common courtesy and mutual respect whilst accessing or using Zyrv or any of its services should be fairly intuitive, and so long as common sense and good judgement are used, should be easily determinable and understood without need of explicit explanation (if you require further information to better understand the nature of these required standards, further information can be readily obtained by performing an internet search for "netiquette"). (4.0.2) The use of profanity may be required on occasion, and therefore, is not strictly forbidden. However, as profanity is regarded as a lax or poor use of online etiquette ("netiquette"), it is expected that profanity will be kept to a minimum. (4.0.3) Swearing at or directing profanity specifically towards other users and/or third parties is strictly forbidden. (4.0.4) Regardless of your age, background, situation and regardless of any external factors or otherwise, you are both expected and required to behave like a mature and rational adult at all times whilst accessing or using Zyrv or any of its services.
4.1; (4.1.0) English is the official language of Zyrv, and therefore, it is both required and expected that your conduct in regards to Zyrv will be entirely in no language other than english, except where explicitly permitted by staff. This clause exists for reasons of accountability — it becomes difficult for moderators to do their jobs if they can't understand what they are moderating. (4.1.1) You are expected to use the english language to the best of your abilities — perfection is not required, but intelligibility is. (4.1.2) You agree that the entirity of your conduct regarding Zyrv will be intelligible. Some examples of good intelligibility include — using accurate spelling and grammar to the best of your abilities; using accurate punctuation (such as ending sentences with periods, question marks or exclamation marks, and ensuring that the beginning of sentences and the first character of the names of people and places are capitalised) and not using cryptic phrasing or doublespeak purely with the intention of confusing other users and/or third parties. (4.1.3) Leetspeak, as well as all variants (such as "leetsp33k", "13375934k", etcetera), is strictly forbidden. (4.1.4) Common internet short-hand, abbreviations and emoticons are wholly permitted.
4.2; (4.2.0) You will not engage Zyrv or any of its services for the propagation of SPAM. Regardless of circumstance, SPAM is strictly forbidden and will not be tolerated. (4.2.1) Exactly what SPAM comprises within the context of Zyrv should be fairly intuitive, and so long as common sense and good judgement are used, should be easily determinable and understood without need of explicit explanation. Though not exhaustive, some generalised examples of SPAM include — Submittions with no meaning, context or purpose; Submittions intended to advertise external services, websites and/or commercial products; hyperlinks to personal and/or commercial websites; excessively weightless and/or entirely unnecessary messages; unnecessary "bump posts"; "triple-posts", "double-posts" and/or unnecessary multiple consecutive posts and etcetera. (4.2.2) That which would generally or usually be regarded as SPAM, where explicitly permitted by staff and/or where appropriately warranted by relevant context, so long as not otherwise in contravention of the ToS, will not be regarded as SPAM and therefore not in contravention of the ToS.
4.3; (4.3.0) Friendly debates are both permitted and encouraged. However, "flaming", "flamewars", "flame-baiting" and/or abusive, malicious and/or aggressive conduct is strictly forbidden and will not be tolerated. Disagreeing with someone is okay, but insulting someone is not. If you can't keep the peace, take your angst elsewhere.
4.4; (4.4.0) These expectations and requirements are not intended to exclude or discriminate — they exist as a means to maintain the quality, usability and enjoyability of Zyrv for the Community as a whole.


5. Submittions.

5.0; (5.0.0) Not excluding the aforementioned requirements, it is both expected and required that, in nature, context or otherwise, no Submittion nor contribution will be of the following — abusive, defamatory and/or slanderous; illicit and/or pornographic; invasive of the privacy of a third party and/or intended as a means of harrassment. This is not an exhaustive list. (5.0.1) Where relevant, the formatting and/or nature of Submittions and contributions must not be tortuous and/or deliberately misleading. For example — user linked and/or contributed images must not contain macros and/or malevolent scripts.
5.1; (5.1.0) The Submittion, contribution and/or linking of "Warez" and/or pirated material of any kind is strictly forbidden.
5.2; (5.2.0) It is both expected and required that neither Submittions nor contributions will have any inherently undesirable effect on the overall layout, aesthetics, usability and/or enjoyability of Zyrv. For example — Submittions must not stretch beyond the intended horizontal limits of their relevant parent containers. (5.2.1) It is both expected and required that all Submittions will be appropriate to their relevant context.
5.3; (5.3.0) Zyrv reserves the right to delete and/or remove Submittions and/or contributions from its database at any time for any reason whatsoever. Though in most cases, it will do so, Zyrv is not required to specify or explain these reasons to you.
5.4; (5.4.0) Contribution of a Submittion to Zyrv will have neither bearing nor effect on your proprietal rights and/or legal relation to said Submittion and/or its constituent components.


6. Copyright.

6.0; (6.0.0) All parts and components of Zyrv, unless explicitly stated as otherwise, are to regarded as and thus treated in the same manner as copyrighted material. (6.0.1) All parts and components of Zyrv, unless explicitly stated as otherwise, where applicable — the relevant copyright owners, proprietors, authors and/or original contributors retain all relevant rights.
6.1; (6.1.0) Excluding where otherwise stated and/or where an alternative agreement or license concerning said material and/or content exists of which is applicable to you, and provided that said material and/or content remains openly available as a part and/or component of Zyrv, Zyrv grants you the right to view and download any material and/or content from its website, provided that such is solely on a personal and non-commercial basis and that such is in full compliance with the ToS.
6.2; (6.2.0) By contributing to Zyrv in any way whatsoever, such as by way of Submittions, you agree that you are legally authorised to do so. Generally, this implicates either that your contributions are neither copyrighted nor legally protected as propriety or that your contributions either belong to you or that you have adequate proprietal rights to authorise your contributing of said contributions. (6.2.1) By contributing a Submittion to Zyrv, unless an alternative agreement and/or license concerning said Submittion exists between you and Zyrv, you grant Zyrv a non-exclusive license to append to and display said Submittion on its website (therefore also granting its users the right to view and download said Submittion, provided that such is solely on a personal and non-commercial basis and that such is in full compliance with the ToS, of which shall mirror the commencement and ending date of Zyrv's license to said Submittion) and, limited to the scope of its website, to store, copy, transmit, retransmit, exhibit and alterate said Submittion as it sees fit, commencing on the date and time of contribution and ending when said Submittion no longer exists as a component of Zyrv. (6.2.2) Zyrv agrees, upon the request of relevant copyright owners, proprietors, authors and/or original contributors, to immediately (upon receiving such a request) remove any Submittion and/or contribution, regardless of reason, and said entities reserve the right to make such a request. However, Zyrv reserves the right to delay such action in the event that such is required by law for the duration of said requirement.
6.3; (6.3.0) Zyrv agrees, regarding any and all parts and/or components of Zyrv, to not undertake any action that surpasses the limitations of its rights regarding said parts and/or components. (6.3.1) You agree, regarding any and all parts and/or components of Zyrv, to not undertake any action that surpasses the limitations of your rights regarding said parts and/or components.
6.4; (6.4.0) Zyrv takes copyright seriously — in the event that material and/or content appears on Zyrv of which it does not have the legal right to display on its website, Zyrv will regard it as a violation of its Copyright Policy and immediately remove it upon becoming aware of such an event.


7. Privacy.

7.0; (7.0.0) Zyrv acknowledges and respects the personal privacy of its users. In the event that Zyrv's Privacy Policy is subject to shortfalls perpending to your relationship with Zyrv and/or perpending to any details regarding you held by Zyrv, where required, Zyrv agrees to work with you to resolve such shortfalls. (7.0.1) Zyrv's Privacy Policy applies to all of its users and applies to the entirity of Zyrv as per defined in 1.1.0, but applies neither to the practises of third parties nor that which is beyond the legal scope of Zyrv.
7.1; (7.1.0) The server that hosts Zyrv automatically records all in-bound requests in what is commonly referred to as an access or server log — this is an automated and uncompromisable process that exists as a component of the server's operating software and is a common practise amongst the vast majority of all servers that exist to-date. You hereby acknowledge and consent to this practise. (7.1.1) Zyrv uses its "Sessions" system as a way of identifying and authenticating users that directly access Zyrv. You hereby acknowledge and consent to this practise. (7.1.2) Zyrv's "Sessions" system relies on cookies as a means to function correctly — upon creating a new session, to identify the new session with its associated user, the system will attempt to instruct the user's browser to create a small and non-invasive cookie. You hereby acknowledge and consent to this practise. (7.1.3) It is neither a requirement of the ToS nor a requirement of continued access to Zyrv that the user allows and/or accepts cookies. Most modern browsers grant the user the ability to enable and/or disable cookies per their personal preference, therefore leaving this choice to their personal discretion. However, should a user not accept cookies from Zyrv, Zyrv will not create a session for the user, thus preventing the user from using and/or accessing any functionality of Zyrv that would otherwise require sessions, such as the Log In and Register functionality. (7.1.4) Zyrv utilises Google Analytics to collect general demographical information regarding its in-bound traffic. You hereby acknowledge and consent to this practise. For further information regarding how this practise works, refer to the openly available documentation on the Google Analytics website. (7.1.5) Practises aforementioned in this policy attain and derive data solely from in-bound requests made to the server and are not capable of attaining or deriving data through any other means. Therefore, the content of this data is ultimately determined by the end user, and under normal circumstances, except where otherwise stated, this data could never and will never be personally identifiable. (7.1.6) A session is not the equivalent of an access/server log, and usually, is only retained for a period of twentyfour (24) hours. (7.1.7) Zyrv will generally not share any of the data attained or derived through the aforementioned practises. However, how and when it does so, remains solely to the discretion of Zyrv.
7.2; (7.2.0) A membership is not a proof of identity, and thus, under ordinary circumstances, will not be regarded as personally identifiable. (7.2.1) Zyrv does not require personal information from its members nor will it actively seek out such information. However, Zyrv does not restrict members from submitting such information of their own accord. The personal information that Zyrv records regarding its members mirrors that which they choose to submit. As such, the member is solely responsible for the personal information that Zyrv records. (7.2.2) The member has the ability to restrict access to their profile, relative to whichever context they feel comfortable with — these restrictions are controlled through options available to the member whilst logged in. Zyrv will honour these restrictions, and therefore, profiles and constituent information will only be as accessible as allowed to be by their relative members. These restrictions do not apply to staff, however, as staff have indiscriminate access to all member profiles. However, should no restrictions be specified, the profile and all constituent information will be publicly available to absolutely anyone, and therefore, can be shared with absolutely anyone. Therefore, ultimately, the member is responsible for how Zyrv shares their personal information. (7.2.3) Zyrv will not, regardless of circumstance, ever, share or display the email address of its members. Zyrv will use its members email address, upon account creation, to enforce validation of the account and to periodically contact the member when required, such as when the ToS is modified. Otherwise, the member may control how Zyrv uses their email address through options available to the member whilst logged in — Zyrv will never use its members email address beyond the scope of what the member permits. (7.2.4) Zyrv is not responsible for the personal information submitted by its members. (7.2.5) As a member, you agree to respect the personal privacy of other members — if another member specifically grants you privvy to personal information that they have not made publicly available, you agree that you will obtain personal permission from said member before using or forwarding on such information; conversely, if you receive personal information regarding another member of which they have not granted you privvy to, you agree that you will obtain personal permission from said member before using or forwarding on such information. (7.2.6) As a member, you acknowledge considering the accessibility of all concerned parts and components of Zyrv prior to submitting personal information to them and both agree and consent to said personal information being subject to the same accessibility — if you post personal information on a publicly accessible part of the forum, said information will also be publicly accessible; conversely, personal information submitted to your profile will be subject to the accessibility specified for your profile. Submitting information of any kind warrants your acknowledgement and consent of said information being submitted. (7.2.7) If personal information which you have not personally made public appears on a publicly accessible part of Zyrv, upon becoming aware of such, Zyrv agrees to immediately remove it. However, in such an event, Zyrv can't guarantee the privacy of such information for the duration of its appearance. (7.2.8) If you choose to make any of your personal information publicly available, you grant Zyrv the right to do as it sees fit with said information in the same maner that the public would be capable of doing, so long as not in contravention of the ToS or any other agreement that exists between you and Zyrv. (7.2.9) Zyrv does not actively share personal information with third parties. Should Zyrv choose to share your personal information with any third parties in the future, Zyrv will seek out your consent before doing so. However, sharing of information with third parties is not a practise that Zyrv actively engages in.


8. Accountability.

8.0; (8.0.0) Zyrv believes in "taking responsibility for your own actions" and "taking responsibility for yourself". As such, you agree that you, solely and in entirity, are responsible and accountable for your own personal actions in regards to Zyrv and its services. Furthermore, all users, each, solely and in entirity, are responsible and accountable for their own personal actions in regards to Zyrv and its services. (8.0.1) You agree to fully indemnify Zyrv, its hosting provider, its partners and all directly and transparently associated entities against any and all damages and liabilities to arise or potentially arise through your access and/or use of Zyrv or any of its services. (8.0.2) Zyrv does not and will not indemnify any of its users against their own responsibility and/or accountability. (8.0.3) As per stated in 2.0.2, Zyrv provides no solid guarantee regarding any of its services. Furthermore, you agree that it is not the responsibility of Zyrv to ensure the conditions described in 2.0.2, such as its ongoing availability. (8.0.4) In the event that a violation of the ToS agreement occurs, the violator is to be held accountable. In the event that an account can be connected with the violation, the account will be treated in the same manner as if it were owned by the violator, regardless of who the true owner is.
8.1; (8.1.0) Zyrv agrees to fully comply and co-operate with, to the extent permittable by law, any legal and law enforcement entities where such has been requested by said entities. This extends to all such entities, regardless of jurisdiction; however, "the extent permittable by law" will be solely and exclusively determined by the laws of and under the jurisdiction of the Commonwealth of Australia. Such requests may be conferred with said entities for verification.
8.2; (8.2.0) In the event of a confliction between a clause of Zyrv's (7) Privacy Policy and a clause of Zyrv's (8) Accountability Policy, the clause of the (8) Accountability Policy supersedes that of the (7) Privacy Policy. (8.2.1) In the event of a confliction between clauses within the same policy and in the event that a clause of the ToS is activated and no outcome that satisfies the ToS can be met, no action will be taken in relation to said event, at a minimum, until said confliction and/or outcome is rectified. However, this clause does not supersede any other clauses within the ToS. (8.2.2) Zyrv believes in resolving disputes as quickly as possible and to the mutual satisfaction of all concerned parties.
